Declaration of a State of Emergency for Ayden, North Carolina

WHEREAS, pursuant to N.C.G.S. §166A, a political subdivision of the state is authorized to declare a State of Emergency in the event of a pending disaster; and
WHEREAS, pursuant to N.C.G.S. §166A-19.22, a political subdivision is defined as an incorporated town of which the Town of Ayden qualifies; and
WHEREAS, pursuant to N.C.G.S. §166A-19.22, a disaster is defined as an occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property from any natural or man-made accidental, military, or paramilitary cause; and
WHEREAS, the National Weather Service is predicting Hurricane Florence, a category 3 / 4 storm, will potentially direct high winds and flood level rainfall over eastern North Carolina, Pitt County and the Town of Ayden.
NOW, THEREFORE, pursuant to the authority vested in me as Mayor by the charter and Code of Ordinances of the Town of Ayden, IT IS HEREBY DECLARED THAT:
Section 1. Pursuant to N.C.G.S. §166A-19.22, I, hereby declare the existence of a State of Emergency in the Town of Ayden, NC.
Section 2. I hereby delegate to Steven L. Harrell, Town of Ayden Manager, authority granted to me for the purpose of implementing an emergency operations and response plan and to take such further action as is necessary to promote and· secure the safety and protection of the populace of the Town of Ayden, NC.
Section 3. Pursuant to N.C.G.S. §166A-19.31 and the charter and Code of Ordinances of the Town of Ayden, NC, I hereby declare that the following prohibitions and restrictions are necessary in order to maintain an acceptable level of public order and services, and to protect lives, safety and property during this emergency, and that the same shall be in effect in the Town of Ayden until this declaration is terminated:
1. The Chief of Police and his subordinates are authorized to restrict or deny access to any area, location or street where such a restriction is necessary in order to help overcome this emergency or to prevent the emergency from worsening. These restrictions on access shall be indicated by means of barricades, posted notices, or orders to anyone in the area.
2. No person shall obtain access or attempt to obtain access to any area, location or street to which the Chief of Police and his subordinates have restricted access according to the above directive.
Section 4. I hereby order this declaration to be distributed as necessary to assure proper implementation of this declaration.
Section 5. This declaration shall become effective at 8 p.m. on the 12th day of September, 2018 and shall remain in effect until terminated pursuant to another declaration issued by the Mayor of the Town of Ayden.
