PUBLIC NOTICE FOR RENEWAL OF FRANCHISE FOR C&D LANDFILL, INC.
NOTICE IS HEREBY given that the Pitt County Board of Commissioners will hold a public hearing on the 10th day of January, 2022 at 6:00 P.M. in the Eugene James Commissioners Auditorium, 1717 West Fifth Street, in order to consider expansion and renewal of a franchise for C&D Landfill, Inc., pursuant to North Carolina General Statute 130A-294.
C&D Landfill, Inc. currently holds a franchise for a part of the described site that is in effect until July 31, 2025. The proposed franchise renewal will replace the existing franchise and is summarized as follows:
TERM OF FRANCHISE: The renewal term of this Franchise shall be Five (5) years from the date of granting of the Franchise Renewal, January 31, 2027.
POPULATION AND AREA TO BE SERVED: The Site is located on US264 near the Pitt County/Beaufort County line. The site serves an area up to 100 miles in radius from the center of the waste area with an estimated population of over 750,000.
TYPE, QUANTITY AND SOURCE OF WASTE: Construction and demolition waste resulting solely from construction, remodeling, repair or demolition operations on pavement, buildings, or other structures. Typical components of the waste stream are gypsum board, lumber, shingles, paper products, plastics and other miscellaneous materials. The most likely average daily rate is 100 tons per day. The Applicant has been granted the authority to receive up to 300 tons per calendar day in order to accommodate future growth or other natural disasters.
ANTICIPATED LIFE OF SITE: The useful life is based on the estimated tonnage per year arriving at the facility. It is estimated the proposed facility will have a useful life of approximately four (4) years.
DESCRIPTION OF SITE: Being all of that tract of land containing 145.237 acres, more or less, located in Pactolus Township, Pitt County, North Carolina more particular described as follows:
Beginning at an iron pipe, the northeast corner of former Tract A, said point of beginning being located in the southern right-of-way of U.S. HWY 264, having N.C. Grid Coordinates (NAD 83) of Northing(Y)=687,614.2207, Easting(X)=2,536,854.1006;thence along leaving said right-of-way and with the western line of Hattie Crandol S 00°28'39" W a distance of 982.50'to an existing iron axle; thence along the eastern line of former Tract A and with the southern line of Hattie Crandol S 65°20'57" E a distance of 921.00'to an existing iron axle, the southwest corner of W.L. Crandol Heirs; thence with the southern line of W. L. Crandol Heirs S 63°49'56" E a distance of 667.98'to an existing iron axle, the southwest corner of John David and Emma Stokes Brewer; thence with the southern line of John David and Emma Stokes Brewer S 64°49'53" E a distance of 937.05'to a computed point, the southwest corner of E J.E. thence N 86°20'27" W a distance of 49.69'to a computed point, the northeast corner of Judson and Ed Whitehurst, the southeast corner of Thomas Buckman and a point in the western line of former Tract A; thence with the eastern line of Buckman N 07°53'47" E a distance of 977.24' to an iron in the southern right-of-way of U.S. Hwy 264, passing thru an existing railroad iron 4.65' from said computed point; thence along the southern right-of-way of U.S. Hwy 264 S 84°40'12" E a distance of 109.13'to an iron pipe; thence continuing with said right-of-way S 84°40'12" E a distance of 103.81'to an iron pipe; thence S 84°40'12" E a distance of 26.08'to an iron pipe, the point of beginning, containing a recombined area of 145.237 Acres more or less (error on plat denotes as 160.4 acres), all according to survey titled “Boundary Survey for C & D Landfill Inc.”, prepared by Burgess Land Surveying, P.A. dated May 8, 2009, recorded in Map Book 72, Page 29, also see Map Book 54, Page 145, Deed Book 1098, Page 156 and Deed Book 2624, Page 762, all recorded in the Pitt County Register of Deeds.
CONDITIONS: The conditions upon which the Franchise renewal is granted are the following:
- The franchisee shall cause any public road leading to the landfill to be cleared of debris at least twice per month for a distance of two miles on both sides of the landfill entrance onto the public road.
- The franchisee shall require that all trucks transporting debris be adequately covered or secured to prevent the spillage of debris.
- The franchisee shall pay to the Pitt County Solid Waste Enterprise Fund a certain sum to be set each year in the fee schedules approved by Board of County Commissioners for every ton of debris taken into the landfill. These funds shall be utilized by the County for solid waste & recycling activities to include that the landfill operates in accordance with all Federal, State, and local regulations and the franchise.
- The franchisee shall comply with all fire prevention regulations and sedimentation and erosion control regulations.
- The franchisee shall provide dust control measures that will not allow dust to leave his property.
- The franchisee hereby gives the County the right to seek up to $500 per calendar day in damages, for violation of the franchise agreement.
- The franchise shall comply with all requirements and provisions of the Rules of the North Carolina Department of Environmental Quality pertaining to C&D Landfills.
